# - indicates dates with restricted training due to unusual legal interpretation.
#a - Weapons report was called in for weapons possession on State property. 4 Honolulu P.D. officers arrived. Practice session was suspended.
#b - Practice resumed after a phone conversation with Honolulu Police Department Sargent Branco who gave approval.
#c - Weapons report was called in for weapons possession on private property. I had been practicing on the beach (public state property). One of 3 arriving officers called me back to the sidewalk, which is private property, and told me I was on private property. He asked me to leave. I asked for and received permission to perform my finale before leaving.
#d - After a phone conversation with Kona Police Department Sargent Paio and direct communication with King Kamehameha Kona Beach Hotel Security Officer John Roberts (in the absence of Security Director Kalei Villacorte) an uninterrupted full practice session was held. This practice session was made possible by the advice of the lovely Blair, of Unison (75-5695 H Alii Drive, Kailua-Kona, HI 96740 808-329-2343), who, although not a lawyer or legal scholar, made clear to me that private property ends at the sand along the beach and that the water and the sand were public property.
#f - Discussions with a few officers culminated with a decision by Ft. Lauderdale P.D. Officer Michael Dodson's decision to curtail training. After further discussions, I resolved to look up the specific FL statute that was applicable. Mid afternoon research led to me to the following 2005 Florida Statutes page. Note Title XLVI (CRIMES) - Chapter 790 (WEAPONS AND FIREARMS) - 790.001 Definitions and 790.29 (4). It is my interpretation that none of my implements falls under the explicitly enumerated items in this code. Note that I returned to the Fort Lauderdale beaches without incident twice during this vacation on 3/20/06 and 3/21/06 after voice mailing both Officer Dodson and the Fort Lauderdale Police Chief the proper statutes to learn regarding weapons and firearm use and after voice mailing the Fort Lauderdale Police Department information regarding my anticipated return visit on 3/20/06.
#g - Miami Beach Fire and Rescue (S. Reynolds) determined that no sports activity (including boogie boards, footballs, and frisbees) could occur on the shoreline due to Spring Break weekend crowds.
#h - Chicago Police Department 20th Pct. Sergeant Sacks arrested me on charges of disorderly conduct. For the entire video of the alleged disorderly conduct see the Youtube video. Although I have previously had city Municipal code disorderly conduct charges dismissed, this citation is under the Illinois Compiled Statutes version of Disorderly conduct: 720 ILCS 5/26-1. Presumably the acts depicted in the video violate the clause "Does any act in such unreasonable manner as to alarm or disturb another and to provoke a breach of the peace." On September 20, 2007, the case was "Stricken Off Leave, Leave Reinstate", which means the case disposed of but the state has 120 days to reinstate it. I filed with various departments within the Chicago Police Department that led to an Internal Affairs Division investigation regarding 1.) unlawful arrest, 2.) likely corruption within the police force related to my pending litigation with the University and influence that may have caused the police officers to be the first to ever put me under arrest, 3.) filing of a false police report with only two of the three officers who hassled me on the beach included in the report and claiming that I carried weapons that I do not own, did not possess and were not confiscated, 4.) the identity of the police officer who told me to "FU(# the constitution" (probably the third officer not properly included in the report). The case has been resolved with insufficient evidence to either prove or disprove my charges. No action was taken on the possibility of a false police report and the identity of a third officer was not revealed to me.
#i - Chicago police asked that I discontinue practice with large implements. They were going to ask me to leave the beach until I described what happened the last time CPD asked me to leave. I did not feel like arguing because I was reading a John Grisham novel and was more interested in relaxing on the beach than usual. I do not intend to concede such rights in the future inside the Park District.
#j - Must not use the bo staff on such a crowded day at such a crowded time.
## - charges of disorderly conduct were filed I believe under the interpretation that practicing martial arts in public is menacing and threatening. Finding: City non-suit (case dismissed) 9/6/02 by Administrative Law Officer Patrick Riley and City Attorney Jason Ziemann.
#1 Richard LaVigne, Wilmette Parks District Assistant Lakefront Manager, informed me that this is a private beach not subject to the public laws that I am familiar with. As such, despite sufficient space for ball and frisbee throwing, martial arts weapons practice with replicas and training implements is not permitted.
$ - indicates dates in which discussions with the authorities averted restricted training.
$# - indicates dates in which discussions with the authorities led to unrestricted implements in a restricted area.
" - there seems to be some discrepancy on whether the Sai is a dangerous weapon. CA PENAL CODE Part 4. Title 2. Chapter 1. Article 2. Unlawful Carrying and Possession of Weapons § 12020 (a) (4) suggests that sais, if state law classifies these unsharpened weapons as daggers, are only unlawful when concealed. FYI, anecdotal evidence says that they are the first choice among weapons for highly skilled weapons masters due to their offensive/defensive versatility. Also, as in my Illinois Department of Natural Resources vs. Antonio Vernon case involving public use and display of martial arts devices it is highly questionable whether these unsharpened daggers where intended to be outlawed along with the majority of daggers which are sharpened. This argument [3.H.2] in the brief at the link above more clearly states in legal terms a closely related objection that you may have seen in prior versions of my site claiming these daggers aren't real. I.E., not only aren't the chrome plated versions that I carry the true implement, they aren't truly the type of implement that was meant to be outlawed in all likelihood.
* - The respect for my grandfathers contributions as a Catholic was acknowledged by the performance of a five decade rosary during the ceremony to celebrate his life. For definitive purposes each decade of a rosary represents a decade of dedicated service to the church and is observed by the performance of an "Our Father" and nine "Hail Mary"'s. Between each decade additional prayers are performed.
N.B.: When I mention a pier I usually mean the adjacent beach to the pier.
N.B.B.: Effective July 2003 the location of any announced beach practice session may change as a result of beach attendance. I am a people watcher and exhibitionist. Empty beaches are no fun.
