On April 23, 2008 Judge Bartkowicz entered an order that upon the request of both parties, that the trial date will be set for September 17, 2008 with a status hearing for such on May 9, 2008. At the status hearing on May 9th, the Judge noted that the trial may commence on September 15, 2008.
According to the trial schedule, defendant had until April 7 to name a damages expert and file their report. They have not done so. Plaintiff has demanded that defendant identify their expert. Their reply produced no identity and they have stated that they did not intend to call an expert. They have confirmed this intention to the court. Case law provides the right reopen discovery to add witnesses during the pretrial time if there is no prejudice to the opposition. It remains to be seen if they intend to call a damages witness although they have forgone their right to call a damages expert.
On March 20, 2008 Judge Bartkowicz enumerated non-privileged documents and ordered their production within ten days. The court also denied plaintiff's motion to reconsider its September 2007 summary judgement ruling on certain breach of contract counts.
In his suit against the University, three claims are now at issue. Two are related to breach of contract and the third is based on tortious interference with contract.
